Any person’s use of Jothrah store, whether as a consumer of a service or a product or otherwise, constitutes their consent and acceptance, while in full legal capacity, of all articles and provisions of this agreement. This confirms your commitment to its regulations as stated herein. This agreement applies to all types of transactions between the consumer and the store. This agreement is effective and binding once you agree to it and begin registration at the store under Article 10 of the Saudi Electronic Transactions Law.
Article 1 - Introduction and Definitions:
The above preamble is an integral part of this agreement. Below are the meanings and definitions of the key terms used in this agreement:
- (The Store): This definition includes all forms of Jothrah store on the internet, whether it is an electronic application, a website, or a commercial shop.
- (The Consumer): Any person engaging in electronic commerce with the desire to obtain products or services provided by the store via its electronic platform.
- (The Agreement): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article 2 - Legal Capacity of the Consumer:
- The consumer acknowledges that they have the recognized legal capacity to deal with the store or are at least eighteen years of age.
- The consumer agrees that in the event of a violation of this article, they shall bear the consequences of such violation before third parties.
Article 3 - Nature of the Obligation:
- The store’s obligation toward consumers is to provide the (Service or Product).
- The store may provide other services, such as after-sales services or other related services, depending on the nature and type of the (Service or Product) requested by the consumer.
Article 4 - Controls for Using the Store:
- The consumer is committed to using the electronic platform of the store in accordance with public ethics and the regulations in force in the Kingdom of Saudi Arabia.
- The consumer is committed, when purchasing a service or product from this store, not to use this service or product in violation of public ethics and the regulations in force in the Kingdom of Saudi Arabia.
Article 5 - Accounts and Registration Obligations:
Upon applying for membership in this store as a user, you are committed to disclosing specific information and choosing a username and a confidential password to be used when accessing the store's services. By doing so, you have agreed to:
- Being responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify this store of any unauthorized use of your account information or any other breach of your confidential information.
- The store shall not, under any circumstances, be responsible for any loss that may befall you, directly or indirectly, morally or materially, as a result of disclosing the consumer’s username or login password.
- You are committed to using your account or membership with the store yourself, as you are fully responsible for it. If someone else uses it, this is a presumption that you have authorized them to use the store in your name and for your account.
- You are committed to using the store with all seriousness and credibility.
- You are committed to disclosing true, correct, updated, complete, and legal information about yourself as required during registration and are committed to updating your data in reality or when necessary.

- The consumer agrees to the possibility of being contacted and notified of any provisions concerning this agreement or dealings with them through the store management broadcasting general messages to all consumers or to specific users of the store.
Article 7 - Amendments to the Usage Agreement and Fees:
- If any article or clause in this agreement is canceled or is no longer effective, this does not invalidate the validity of the remaining articles, clauses, and rules, which remain in effect until further notice from the store management.
- This agreement—which is amended from time to time as necessary—constitutes the working mechanism, understanding, and agreement between (The Consumer) and (The Store).
- The store may impose fees on some consumers depending on the offers, products, or services they request, or what the state imposes in terms of fees or taxes on the nature of the product or service.
- The store reserves the right to add, increase, decrease, or discount any fees or expenses under the provisions of the usage agreement for any consumer, regardless of the reason for their registration.
Article 8 - Payment and Settlement Services:
- The store provides, through its partners, the payment and settlement system in the store. This can be done entirely online through the payment options available in the store or through any payment method provided by the store from time to time.
- The store is committed to determining the price of the service or product it displays in its store according to the recognized market value.
- The store is committed to providing invoices and receipts for all amounts and profits arising in its store and is committed to giving the consumer an invoice for their purchase of a service or product.
- The store is committed to providing recognized accounting specifications in its online store, in application of the provisions of this agreement and for the legal, economic, commercial, and regulatory interests of this organization.
Article 9 - Intellectual Property:
- Intellectual property rights of the store are fully owned by the store, whether owned before or after the establishment of this electronic platform.
- The consumer must respect the intellectual property rights of the store, which include the store name itself, words, logos, and other symbols of the store or those displayed on it, as every right associated with the store name is a full intellectual property right of the store.
Article 10 - Responsibility of the Store:
- The store is committed to conducting its business through this electronic platform formally and in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
- The store is not liable for any claims arising from errors or negligence, whether caused directly, indirectly, by the consumer, or by a third party such as shipping companies.
- Jothrah for Fertilizers & Pesticides, its employees, owners, and representatives are committed to ensuring that the (Product or Service) is sound, legitimate, and authorized according to the laws and regulations of the Kingdom of Saudi Arabia and used for legitimate purposes.
Article 11 - Restriction of Access or Membership:
The store may suspend or cancel a consumer's membership or restrict their access to the platform's services at any time, without notice, for any reason, and without limitation.
Article 12 - Governing Law:
This usage agreement is governed and formulated according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully and completely subject to the regulations in force at the authorities in the Kingdom of Saudi Arabia.

Article 13 - General Provisions:
If any article or clause in this usage agreement is canceled or no longer effective, this does not invalidate the validity of the remaining articles and provisions, which remain in effect until further notice from the store management. This agreement—which may be amended from time to time—constitutes the agreement, working mechanism, and contract between the store and the consumer. Both parties also agree to take the following into account:
- Arabic is the official language when interpreting the provisions of this agreement or when translating it into another language.
- All prices displayed for the store's services or products may be modified from time to time.
- Promotional or marketing offers that the store may place are temporary; the store has the right to modify or stop these promotional or marketing offers at any time.
- The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules and the relevant laws and regulations related to the nature of the transaction between the store and the consumer.
- This usage agreement is only canceled by a decision issued by the store management.
